1. Agreement to these terms

These Terms of Use (“Terms”) govern access to and use of this website. The website is operated by Josh’s Web Solutions, which may also operate or identify itself as Josh’s Computer Services, Josh, or Josh Jovovich. In these Terms, those names are referred to collectively as “Josh’s Web Solutions,” “JWS,” “Josh,” “we,” “us,” or “our.”

By accessing or using the website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the website or submit its forms.

2. Website purpose and no automatic client relationship

This website provides general information about JWS, displays selected portfolio work, and allows visitors to request information about possible services. Website content is informational and is not legal, tax, financial, or other regulated professional advice.

Visiting the website, activating a preview, or submitting a form does not create a developer-client, contractor, fiduciary, or other professional relationship. Any paid project, deliverables, ownership terms, schedule, fees, warranties, support obligations, and other service terms must be established in a separate written proposal, statement of work, contract, or other agreement accepted by JWS and the client. If a separate agreement conflicts with these Terms concerning paid services, the separate agreement controls for those services.

3. Acceptable use

You may use the website for lawful informational and business-inquiry purposes. You may not:

  • use the website in violation of any applicable law or another person’s rights;
  • submit false, deceptive, unlawful, infringing, malicious, or abusive content;
  • probe, scan, disrupt, overload, bypass, or attempt unauthorized access to the website or its providers;
  • introduce malware, harmful code, automated spam, or excessive requests;
  • interfere with forms, preview controls, security measures, or another visitor’s use;
  • impersonate another person or misrepresent your affiliation or authority;
  • scrape, copy, or republish substantial website content for a competing commercial purpose; or
  • use project names, marks, images, or website previews in a way that implies an unauthorized endorsement.

We may restrict access, disregard submissions, or take other reasonable action when use violates these Terms or threatens the website, its providers, JWS, clients, or other users.

4. Forms and electronic communications

You are responsible for ensuring that information submitted through a form is accurate and that you have authority to provide it. Do not submit confidential information, account credentials, payment-card information, government identifiers, health information, or other sensitive data through the website.

By submitting a Project Inquiry or Website Assessment request, you authorize JWS to contact you about that request using the information you provide. Submission does not guarantee acceptance of a project, a response by a particular deadline, a free service beyond what JWS expressly agrees to provide, or any particular recommendation or result.

Form delivery depends on third-party hosting and filtering services. Although JWS uses reasonable measures to support reliable delivery, a submission may be delayed, rejected as spam, or fail because of network or service conditions. If a matter is urgent, use another established communication channel.

5. Portfolio previews and third-party websites

The portfolio contains poster images, links, and optional interactive frames showing websites created for or associated with other businesses. Those businesses, names, logos, content, offers, contact details, and services remain the responsibility of their respective owners. Their appearance in the portfolio does not transfer ownership to JWS or imply that JWS operates every displayed business.

Live previews load an external website only after you activate them. Once loaded, the external site is governed by its own terms, privacy policy, accessibility, availability, and content practices. JWS does not control cross-origin content inside an embedded website and is not responsible for later changes made to it, transactions with its operator, or information you submit directly to it.

Links and previews are provided for convenience and portfolio demonstration. A link does not constitute a guarantee, sponsorship, or endorsement of every statement, product, service, or third-party practice found at the destination.

6. Intellectual property

Except for client materials, third-party marks, open-source components, or content otherwise identified, the JWS website’s original design, layout, copy, code, graphics, and presentation are owned by Josh’s Web Solutions or used with permission and are protected by applicable intellectual-property laws.

JWS grants you a limited, revocable, nonexclusive, nontransferable license to view and use the website for personal or internal business-evaluation purposes. No other license is granted. You may not copy, reproduce, modify, distribute, sell, sublicense, remove ownership notices from, or create derivative works from substantial portions of the website without prior written permission, except as permitted by law.

Client and third-party business names, logos, photographs, and website content remain the property of their respective owners. All rights not expressly granted are reserved.

7. Accuracy, results, and availability

JWS aims to keep website information useful and accurate, but content may be incomplete, become outdated, or contain errors. Services, availability, processes, technology, and portfolio websites may change without notice. Examples are provided to demonstrate work and are not promises that another project will have identical features, appearance, performance, cost, schedule, business results, search rankings, traffic, leads, or conversions.

We may modify, suspend, or discontinue any website feature, including live previews and forms, at any time. We do not guarantee uninterrupted, error-free, secure, or universally compatible operation.

8. Disclaimers

To the fullest extent permitted by law, the website and all website content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. JWS disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and uninterrupted or error-free operation.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

9. Limitation of liability

To the fullest extent permitted by law, JWS and its owner will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunities, or use, arising from or related to the website, forms, previews, links, or these Terms, even if advised that such damages were possible.

To the fullest extent permitted by law, JWS’s aggregate liability arising solely from your use of this public website will not exceed one hundred U.S. dollars ($100). This limitation does not apply to liability that cannot legally be limited. Liability relating to paid client services is governed by the applicable separate client agreement.

10. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless JWS and its owner from third-party claims, damages, obligations, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your unlawful use of the website, your submitted content, your violation of these Terms, or your infringement of another person’s rights. This section does not require indemnification for conduct caused solely by JWS where prohibited by law.

11. Governing law and severability

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute not governed by a separate client agreement must be brought in a court of competent jurisdiction in California, unless applicable law requires otherwise.

If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted or modified only as necessary, and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement concerning use of this public website.

12. Changes to these terms

We may update these Terms when the website, business practices, or legal requirements change. Updated Terms will be posted at this location with a revised effective date. Changes apply prospectively when posted unless applicable law requires another form of notice. Continued use after an update constitutes acceptance of the updated Terms.
